Frequently asked

Questions Bratton Law Group hears every week.

Do I really need both a will and a power of attorney?
They solve different problems. A will controls what happens after you pass away — who inherits, who's executor. A durable power of attorney lets someone you trust handle finances and medical decisions while you're alive but unable to. Most NJ and PA families need both, plus an advance healthcare directive.
Will Medicaid take my house?
Not necessarily — but timing and planning matter enormously. New Jersey and Pennsylvania each have specific rules about asset transfers and lookback periods. With proper legal planning, families can preserve their home and other assets while still qualifying for Medicaid to cover long-term care. The earlier you start, the more we can protect.
How is Life Care Planning different from a normal lawyer's advice?
Most firms hand you documents and send you on your way. Our elder-law attorneys work side-by-side with our Elder Care Coordinators (licensed social workers) — so legal planning and real-life care planning happen together, with one team that stays with your family for as long as you need us.
What does a consultation cost?
Your first 15-minute consultation is free and completely confidential. We'll listen to your situation and explain your options — even if it isn't with us. If you choose to work with Bratton Law Group, we use clear flat-fee pricing wherever possible, so you know your costs up front.
